1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Low Latency Labs LLC ("Company," "we," "us," or "our") concerning your access to and use of the TinyWise mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

TinyWise is a parenting support application that provides:

  • Behavior translation tools to help understand children's emotional needs
  • Guided calming activities for parents and children
  • Parenting reflection journal
  • Progress tracking and insights

Important: TinyWise is designed for educational and informational purposes only. It is not a substitute for professional medical, psychological, or parenting advice. Always consult qualified professionals for specific concerns about your child's development or behavior.

3. User Accounts

To access certain features of the App, you may need to create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

Free and Premium Tiers

TinyWise offers both free and premium subscription options. Free users have access to limited daily translations and features. Premium subscribers receive unlimited access to all features.

Billing

Premium subscriptions are billed through the Apple App Store or Google Play Store. By subscribing, you agree to:

  • Pay the applicable subscription fees
  • Accept automatic renewal unless canceled before the renewal date
  • Manage subscriptions through your App Store or Google Play account

Refunds

Refund requests are handled by the Apple App Store or Google Play Store according to their respective refund policies. We do not process refunds directly.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality
  • Reverse engineer, decompile, or disassemble the App
  • Share your account credentials with others
  • Use the App to harm, exploit, or endanger children

6. Intellectual Property

The App and its original content, features, and functionality are owned by Low Latency Labs LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

7. User Content

You retain ownership of content you create within the App (such as journal entries and child profiles). By using the App, you grant us a limited license to store and display this content solely to provide the App's functionality.

We do not claim ownership of your content and will not use it for any purpose other than providing and improving the App.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

THE PARENTING SCRIPTS AND RECOMMENDATIONS PROVIDED BY THE APP ARE FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE CONSIDERED PROFESSIONAL ADVICE. RESULTS MAY VARY.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOW LATENCY LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Low Latency Labs LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or by other means. Your continued use of the App after such changes constitutes acceptance of the new Terms.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by deleting your account through the App or by contacting us.
